General Terms and Conditions of Sale
The conditions of sale have the aim of defining the conditions under which the sales of products suggested by the Allande Company are carried out, 12 avenue Louis Ricoux, 87210 LE DORAT, registered with the RCS of Limoges under the number B 394.715.544, with any person wanting to carry out a purchase via the Shop on Line on the www.allande.fr site.
The Net surfers can take note of the general conditions of sale on: www.allande.fr.
The general conditions of sale are written in French language and Allande reserves the right to modify them constantly. The general conditions of sale applicable are those presented on the site at the moment when the customer places his order.
The products sold by Allande are marketed under the marks “Allande” and “Tanaïs”. The Allande Company presents on its site the products available for sale with the characteristics of each product, pursuant to the Code of Consumption.
The Allande Company has the exclusiveness in the sale of the products marketed under the marks “Allande, Alcée, Tanaïs” on Internet site www.allande.fr. Any marketing of the aforesaid products on other Internet sites could be likely to engage the civil and even penal liability of their authors.
The prices of our products are indicated in euros including the tax (VAT). These prices do not take account of the expenses of treatment and forwarding which are indicated to you during the ordering. Allande reserves the right to modify its prices constantly, but the invoiced price will be that in force at the time of the placing of the order. The deliveries apart from the European Convention country and DOM TOM can generate custom charges and others perceived with the delivery. These possible expenses are the responsibility of the recipient.
Any order is made on the www.allande.fr site by respecting the instructions communicated on the site to this end.
You state to have taken knowledge and to accept the general conditions of sale before the making of your order. The validation of your order carries acceptance of these general conditions of sale. Except contrary proof, the data recorded on the site constitute the proof of the transactions passed between Allande and its customers. We confirm any order placed on our site by electronic mail. This mail confirms that your order was indeed recorded and informs you of the methods of his delivery (addresses delivery, number of order, conveyer nomination) and availability of the products
The payment of your purchases is carried out by bank card VISA – EUROCARD – MASTERCARD.
Allande profits from the protected system Pay Box.
The data relating to your number of bank are encrypted starting from your computer and are thus transmitted encrypted directly to the banking operator who deciphers them and manages the authorization of taking away.
The flow of the chart is carried out immediately after the validation of your order.
The products are delivered to the address indicated in your order.
The delivery takes fourteen (14) business days in metropolitan France and twenty (20) business days for French overseas territories and foreign countries. This is the only delay that undertakes the company. For information only, the average delivery period is lower than 7 days.
In case of delay in delivery, Allande will keep you informed. You can also have the possibility to send us an email: firstname.lastname@example.org or to call the customer service: 0 801 800 923 (non-surcharged call to Metropolitan France) from Monday to Thursday, 10:00 am to 12:00 am and 3:00 pm to 5:00 pm and Friday morning, 10:00 am to 12:00 am, except public holiday.
The Company will do the necessary to determine the cause of the delay and to find the right solution to solve the problem as soon as possible. If the products are not available, you will be informed by electronic mail. You will then have 3 possibilities:
- Change the product for another one (same price and quality).
- Be reimbursed (price of the product) at the latest 30 days after the payment of your order. If the parcel is deteriorated, damaged or open during the delivery, you must imperatively express reservations on the delivery order. You must preserve a specimen and address a double of your complaint to the customer service, by email: email@example.com or by sending a letter registered with notice of receipt (Allande, Customer service, 12 avenue Louis Ricoux, 87210 LE DORAT).
- The Company uses the Post office according to the system “Colissimo Suivi” or a conveyer. You will be able to track your order by connecting you into your personal account.
Guarantees: The seller is bound by the legal guarantee of conformity mentioned in the French Consumer Code (from L.217-4 to L.217-16) and articles (from 1641 to 1648 and 2232) of the French Civil Code.
French Consumer Code:
Article L.217-4 of the French Consumer Code:
“The seller shall deliver a good that complies with the contract and shall be liable for compliance defects that exist when the good is handed over.
The seller shall also be liable for any compliance defects that result from the packaging, assembly instructions or installation if the seller was responsible for installation pursuant to the contract or was carried out under its responsibility.”
Article L.217-5 of the French Consumer Code:
“The good complies with the contract:
1) If it is suitable for the habitual use that is expected of a similar product and, as applicable:
- If it corresponds to the description given by the seller and has the qualities that the seller presented to the purchaser in the form of a sample or model;
- if it has the qualities that a purchaser can legitimately expect given the declarations made by the seller, by the manufacturer or by its representative, in particular in the advertising or labelling;
2) Or if it has the characteristics defined by a mutual agreement by the parties or is suitable for any specific use required by the purchaser, which was brought to the attention of the seller and that the seller accepted.”
Article L.217-12 of the French Consumer Code:
“Actions that result from a compliance defect are time-barred two years after the good is handed over.”
Article L.217-16 of the French Consumer Code:
“When the purchaser asks the seller, during the period of the commercial warranty that was granted to the purchaser when movable property was acquired or repaired, for refurbishment that is covered by the warranty, any period during which the property cannot be used of at least seven days shall be added to the remaining duration of the warranty.
Said period shall start to run as from the request for action by the purchaser or the handing over of the property for repair, if this is after the request for action.”
French Civil Code:
Article 1641: The seller is bound to warranty in respect of secret defects in the thing sold which render it improper for the use to which it is destined, or which so far diminish such use, that the buyer would not have purchased it, or would not have given so large a price, if he had known them.
Article 1648: The action resulting from faults annulling the sale must be brought by the purchaser, within a short interval, according to the nature of such faults, and the usage of the place where the sale was made
All our items are systematically inspected at the exit of our workshops. However, if an item appeared defective, we commit ourselves to replace it by an identical product.
Any request for exchange will have to be done by the customer. The customer must submit his request for exchange by electronic mail: firstname.lastname@example.org or by calling the customer service: 0 801 800 923 (non-surcharged call to Metropolitan France) from Monday to Thursday, 10:00 am to 12:00 am and 3:00 pm to 5:00 pm and Friday morning, 10:00 am to 12:00 am, except public. The customer has 8 days from receipt of the product to contact us. This request must indicate the defect (s) of the defective product.
Our customer service will inform the customer, by electronic mail, of its decision to accept or refuse the exchange. However, the final acceptance will be done only after the reception of the defective product turned over by the customer and the effective observation of the defect (S). When the exchange is definitively accepted by the company, the expenses of return and the forwarding costs of the identical product will be dealt with by the Company. However, the expenses of return will be refunded only if the customer presents a supporting document. The items must be in their intact packing of origin and in a perfect state of cleanliness. If the procedure is not respected, the exchange will not be accepted.
However if the identical product is no longer available, Allande will informed the customer by electronic mail. You will then have 2 possibilities:
- Change the product for another one (same price and quality)
- Be reimbursed (price of the product). The reimbursement will be done after the receipt and the inspection of the product. We remain you that the customer is reliable. The product must be returned in new conditions. The reimbursement will be done within 14 days after the receiver of the order and by the same payment mean.
The validation of your order takes total and irrevocable acceptance of the General Terms and Conditions of Sale.
In conformity to the article L.221-18 of the French Consumer Code, you have 14 (fourteen) days from receipt of your order in which to exercise your right of withdrawal. To exercise the right of withdrawal, you must notify us: your name, your address and your decision to withdraw the contract by means of an unambiguously declaration.
As soon as we receive the product(s), the company will reimburse all payments received to the customer. This repayment will be made using the same means of payment of the original transaction.
However, the customer will pay for the expenses of sending and return of the products. The product must be returned with its original packaging in complete and in a perfect state.
Exception to the right of withdrawal: Under the provisions of article L.121-21-8 of the French Consumer Code, the right of cancellation does not apply to supply of good packaged according to consumer’s specification.
The customer is informed that the right of withdrawal may not be exercised for products which were unsealed by the consumer after the delivery. The products cannot be sent back for reasons of hygiene and health protection. The products concerned are the panties (underwear) and the lingerie sets (batch of products).
All the texts, comments, illustrations and images reproduced on the www.allande.fr site are reserved for the whole world in accordance with the Right of the French and international intellectual Property.
For this reason and in accordance to the Code of the Intellectual Property, only a private use subject to different provisions, even more restrictive that those from the Code of the Intellectual Property, is authorized. Their representation and their total or partial reproduction is strictly prohibited.
Information and data concerning you are necessary to the treatment of your orders.
When you place an order at the Allande company you accept the present general conditions of sale and you authorize us to use the personal data concerning you and the possibly to yield them.
If you are not agree with that, you can inform us by electronic mail with email@example.com or by postal mail recommended with notice of receipt addressed to Allande, Customer service, 12 avenue Louis Ricoux, 87210 LE DORAT.
In accordance with the Data-processing Law and Freedom of January 6, 1978, you have the right to access and to correct the personal data concerning you by sending us an electronic mail or by writing us to the addresses indicated above.
The contract is subjected to the French Right.
In the event of litigation, in the absence of out-of-court settlement, the courts within the competence of Limoges will be the only qualified.
